Welcome to QRKavach. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and QRKavach ("Company", "we", "us", or "our"). Please read them carefully before using our website, platform, or any related services.
1. Acceptance of Terms
By accessing or using QRKavach's website, mobile-optimised platform, QR sticker services, or any associated features (collectively, the "Service"), you confirm that you have read, understood, and agree to be legally bound by these Terms, together with our Privacy Policy, which is incorporated herein by reference.
If you do not agree with any part of these Terms, you must immediately stop using the Service. Your continued use of the Service after any modification to these Terms constitutes your acceptance of the revised Terms.
2. Eligibility
You must be at least 18 years of age and legally capable of entering into a binding contract under the Indian Contract Act, 1872, to use the Service. By registering an account, you represent and warrant that:
- You are at least 18 years old;
- You are a resident of India or are accessing the Service from a jurisdiction where its use is lawful;
- All information you provide during registration is accurate, current, and complete;
- You are not barred from receiving services under applicable law.
QRKavach reserves the right to refuse service to anyone for any reason at any time, including if we have reasonable grounds to believe a user is under 18 or is providing false information.
3. Description of Service
QRKavach is a privacy-first identification and recovery platform that enables owners of vehicles, laptops, luggage, pets, and other personal assets to be contactable by strangers — without ever exposing their real phone number or personal details. The Service includes:
- QR Stickers: Weather-resistant, tamper-evident QR code stickers affixed to assets. When scanned, they route the finder to a secure contact interface.
- Masked Call Relay: An anonymous telephony relay that connects a finder to the asset owner without revealing either party's real phone number.
- WhatsApp & SMS Alerts: Automated notifications sent to the owner when someone scans their sticker, subject to plan-based monthly quotas.
- Push & Email Notifications: Real-time alerts delivered via browser push and registered email address.
- Contact History & Dashboard: A secure account dashboard that logs all contact attempts associated with the owner's stickers.
- GPS City Hint (Gold & above): An approximate location (city level) shown to the owner when a sticker is scanned.
QRKavach reserves the right to modify, suspend, or discontinue any feature of the Service at any time, with reasonable notice where practicable.
4. Account Registration & Responsibilities
To access the full features of the Service, you must create an account. You agree to:
- Provide accurate, complete, and current registration information;
- Maintain and promptly update your account information as necessary;
- Keep your password confidential and not share it with any third party;
- Notify us immediately at support@qrkavach.com of any suspected unauthorised access to your account;
- Accept full responsibility for all activities that occur under your account.
QRKavach shall not be liable for any loss or damage arising from your failure to comply with these obligations. One person or legal entity may not maintain more than one free account.
5. Subscription Plans & Pricing
QRKavach offers a free tier (Basic) and multiple paid subscription tiers (Silver, Gold, Business). Each tier provides different feature limits including the number of registered stickers, masked call quota, WhatsApp/SMS quota, and advanced features. Current plan details and pricing are available on our Pricing page.
- Basic (Free): Perpetually free. Includes limited masked calls per month and core push/email notifications.
- Silver / Gold / Business: Annual paid plans billed in a single payment. Upgraded quotas, additional stickers, and premium features as described on the Pricing page.
Monthly quotas (masked calls, WhatsApp messages, SMS) reset on the 1st of each calendar month. Unused quota does not carry forward.
QRKavach reserves the right to change plan pricing and features with at least 30 days' advance notice to existing subscribers via email.
6. Payment Terms
All prices are displayed and charged in Indian Rupees (INR). Applicable Goods and Services Tax (GST) is included in the displayed price unless stated otherwise.
- Paid subscriptions are billed annually in advance at the time of purchase.
- Payments are processed through our authorised payment gateway partners. QRKavach does not store your card or UPI details.
- Subscriptions auto-renew at the end of each annual period unless cancelled at least 7 days before the renewal date.
- If a renewal payment fails, your account will revert to the Basic (free) tier. Paid features will be suspended until a successful payment is made.
7. Refund & Cancellation Policy
Subscription Plans:
- You may request a full refund within 7 days of your initial subscription purchase, provided you have not activated any sticker under the paid plan or used any paid quota (masked calls, WhatsApp, SMS).
- After 7 days, or if paid features have been used, no refund will be issued.
- Renewal payments are non-refundable once processed.
Physical Sticker Orders:
- Stickers are custom-printed and personalised. They are non-refundable and non-returnable once shipped.
- If stickers are delivered in a damaged condition, notify us within 48 hours of delivery with photographic evidence at support@qrkavach.com. We will arrange a replacement at no additional cost.
Refund requests must be submitted by email to support@qrkavach.com with your registered email address and order/transaction reference. Approved refunds are processed within 7–10 business days to the original payment instrument.
This policy is consistent with the Consumer Protection Act, 2019 and associated e-commerce regulations applicable in India.
8. Sticker Orders & Delivery
Physical QR stickers are shipped within India via standard courier services. Estimated delivery timelines are displayed at checkout and are not guaranteed. QRKavach is not responsible for delays caused by courier partners, customs, or circumstances beyond our reasonable control (force majeure).
- Stickers are dispatched to the shipping address provided at checkout. Ensure the address is accurate before placing your order.
- International shipping is not currently available.
- Risk of loss or damage passes to you upon handover to the courier.
9. Prohibited Uses
You agree not to use the Service to:
- Violate any applicable law, regulation, or court order, including the Information Technology Act, 2000 and its rules;
- Harass, stalk, threaten, abuse, or harm another person using the relay or notification system;
- Impersonate any person or entity, or falsely claim an affiliation with any person or organisation;
- Register stickers on assets you do not own or are not authorised to register;
- Attempt to reverse-engineer, decompile, or interfere with the relay infrastructure, QR encoding system, or any part of the Service;
- Use automated tools (bots, scrapers, crawlers) to access the Service without prior written consent;
- Transmit spam, unsolicited messages, or malicious software through any notification channel;
- Collect or harvest personal data of other users without their explicit consent;
- Use the Service for any commercial purpose other than as expressly permitted by these Terms.
Violation of this section may result in immediate account suspension, termination, and, where applicable, referral to law enforcement.
10. Privacy & Data Protection
Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference. We encourage you to read it carefully.
QRKavach processes personal data in accordance with the Digital Personal Data Protection Act, 2023 (DPDP Act) and the Information Technology Act, 2000. The relay architecture is specifically designed so that:
- Your real phone number is never disclosed to a finder when they initiate a masked call or message;
- A finder's contact details are not stored beyond what is necessary for the contact attempt log;
- All communication through the relay is encrypted in transit.
11. Intellectual Property
All content, software, source code, databases, branding, logos, trademarks, trade names, and design elements associated with QRKavach are the exclusive property of the Company or its licensors, and are protected under applicable Indian and international intellectual property laws.
Subject to your compliance with these Terms, QRKavach grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service solely for your personal, non-commercial purposes.
You may not copy, reproduce, modify, distribute, sell, lease, sub-licence, or create derivative works based on any part of the Service without prior written consent from QRKavach.
12. Disclaimers
The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, QRKavach disclaims all warranties, including but not limited to:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement;
- Warranties that the Service will be uninterrupted, error-free, or free of viruses or other harmful components;
- Warranties that a lost or stolen item will be recovered as a result of using the Service.
QRKavach does not guarantee that masked calls or notifications will be delivered successfully in all circumstances, as delivery depends on factors outside our control (network availability, carrier policies, device settings).
13. Limitation of Liability
To the maximum extent permitted by applicable law, QRKavach, its directors, employees, agents, and affiliates shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages;
- Loss of profits, revenue, data, goodwill, or other intangible losses;
- Failure to recover a lost or stolen asset;
- Damages resulting from unauthorised access to or alteration of your data;
- Damages resulting from your reliance on the Service.
In all cases, QRKavach's total aggregate liability to you shall not exceed the greater of (a) INR 1,000 or (b) the total amount paid by you to QRKavach in the 12 months immediately preceding the event giving rise to the claim.
14. Indemnification
You agree to defend, indemnify, and hold harmless QRKavach and its officers, directors, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with:
- Your access to or use of the Service;
- Your breach of these Terms;
- Your violation of any applicable law or the rights of any third party;
- Any content or data you submit, post, or transmit through the Service.
15. Termination
Either party may terminate the agreement under these Terms at any time.
Termination by You: You may close your account at any time from your account settings. If you are on a paid plan, your subscription will continue until the end of the current billing period and will not be renewed thereafter.
Termination by QRKavach: We may suspend or permanently terminate your account, with or without notice, if: (a) you breach these Terms; (b) we are required to do so by law or court order; or (c) continued provision of the Service is no longer commercially viable.
Upon termination: your right to access the Service ceases immediately; your stickers will be deactivated; and any contact attempts will no longer be relayed. Sections 10, 11, 13, 14, and 16 of these Terms survive termination.
16. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Republic of India, including the Information Technology Act, 2000; the Consumer Protection Act, 2019; and the Digital Personal Data Protection Act, 2023, without regard to conflict-of-law principles.
Step 1 — Informal Resolution: If you have a dispute with us, please first contact support@qrkavach.com. We will make good-faith efforts to resolve the issue within 30 days.
Step 2 — Consumer Forum: If the dispute is not resolved informally, individual consumers may escalate to the appropriate consumer dispute redressal forum under the Consumer Protection Act, 2019.
Step 3 — Courts: For disputes not covered by the consumer forum mechanism, the parties irrevocably submit to the exclusive jurisdiction of the competent courts in Ahmedabad, Gujarat, India.
17. Changes to These Terms
QRKavach reserves the right to modify these Terms at any time. We will provide at least 14 days' advance notice of material changes by:
- Sending an email to the address associated with your account; and/or
- Posting a prominent notice on the QRKavach website.
Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service and close your account before the effective date.
